These Terms of Business govern the relationship between the travel agency Noctua Travel (“the agency”) and the traveller (“the passenger”) when booking and using the agency’s services. By making a booking, the passenger confirms they have read and accepted these terms.
Noctua Travel organizes and intermediates trips, excursions and related tourism services within Croatia and abroad. Depending on the specific offer, the agency may act either as the trip organizer or as an intermediary between the passenger and the actual service provider (accommodation, transport, guiding, etc.); this is stated in each individual offer.
A booking is made by submitting a request through the contact form, by e-mail, or by phone, followed by written confirmation from the agency. The contract is considered concluded once the agency confirms the booking and the passenger pays the agreed deposit or full amount, as specified in the offer.
Unless otherwise agreed in writing, a deposit is payable at the time of booking, with the remaining balance due no later than 30 days before departure. Accepted payment methods are stated in the offer or invoice.
If a passenger wants to cancel a confirmed trip, the cancellation must be submitted in writing by e-mail to info@noctuatravelcroatia.com. The date the written cancellation is received is used to calculate the cancellation cost. If the passenger who cancels finds a replacement who meets all the required conditions and is willing to take their place, the agency will only charge the costs caused by the change.
Otherwise, if a paid booking is cancelled, the agency withholds a booking fee of 10% of the total price, plus the following amounts depending on how far in advance the cancellation is made:
The agency reserves the right to cancel or modify a trip in cases of insufficient bookings, force majeure, or circumstances beyond its control (extreme weather, travel bans, safety risks, etc.). In such cases, passengers will be offered an alternative date, an alternative trip, or a full refund of amounts paid, in line with the law.
The agency undertakes to provide services in accordance with the description in the confirmed offer. Where the agency acts solely as an intermediary, liability for the performance of the service lies with the actual service provider (hotel, carrier, local partner, etc.), in line with their own terms of business.
Unless explicitly stated as included in the offer, travel health insurance and trip cancellation insurance are not included in the price and are recommended to all passengers, particularly for trips abroad.
Passengers are responsible for their own baggage and personal belongings during the trip. The agency is not liable for loss, theft or damage of personal items, except where this occurred due to the agency’s own fault.
The procedure and deadline for submitting a complaint about the quality of our services are set out in the “Agency information” section below, in accordance with the Consumer Protection Act.
Personal data submitted when making an enquiry or booking is processed in accordance with our Privacy Policy.
These terms are governed by the laws of the Republic of Croatia, in particular the Act on the Provision of Tourism Services and the Consumer Protection Act. Any disputes will primarily be resolved amicably; otherwise, the competent court in Croatia has jurisdiction.
